İnsan kaynakları yönetiminin hukuki boyutları: iş gören seçimi ve iş ilişkisinin sonlandırılması üzerine bir değerlendirme
Özet
Bu araştırmanın temel amacı insan kaynakları yönetiminin hukuki boyutlarını
incelemektir. Araştırma bu temel amaç bağlamında iş gören seçimi ve iş ilişkisinin
sonlandırılması üzerine bir değerlendirmeyi yapmayı da amaçlamıştır. İş gören tercihi
işletmeler için ticari ve ekonomik rekabetin bir unsuru olmaya devam etmektedir.
Nitekim her işletme nitelikli iş görenlerle çalışmak istemektedir. Ancak hem iş
görenlerin hem de işverenlerin birbirlerinden karşılıklı beklentileri olmaktadır. Bu
beklentilerin yasal bir çerçevede ele alınması iş sözleşmesi gerekliğini doğurmaktadır.
İş sözleşmelerin feshi ise hem işverenler hem de iş görenler için bir takım yaptırımlar
getirmektedir. Bu bağlamda gerek iş mahkemelerinin gerekse de özel hakemlerin
dikkat çektiği husus sözleşme fesih nedenlerinin haklı ve geçerli nedenlerle yapılıp
yapılmadığının incelenmesi olmaktadır. Nitekim sözleşmeler geçerli nedenlerle
yapılmadığı takdirde mahkemeler genellikle iş gören lehine kararlar vermektedir.
Yapılan literatür incelemesi sonucunda işverenlerin birçok farklı sebepten iş
sözleşmelerini tek taraflı fesih ettiği gözlemlenmiştir. İş görenin etik tutumundan
kaynaklı fesih nedenleri dışındaki nedenlerle fesih edilen sözleşmeler iş görenlerin
mağduriyetine sebep olmaktadır. Ayrıca birçok işletmenin iş sözleşmelerini de
yapmadığı tespit edilmiştir. İş gören işvereni dava ederek hakkını aradığında sonuçlar
iş gören lehine olsa da aynı işverenler çalışması zorlaşmaktadır. Gelinen noktada
işveren denetimlerini devletin ve kamusal kurumların sıklıkla ve titizlikle yapması
gerekmektedir. The main purpose of this research is to examine the legal aspects of human
resources management. The research also aimed to make an evaluation on the selection
and the termination of the business relationship in the context of this fundamental
purpose. The business preference continues to be an element of commercial and
economic competition for businesses. As a matter of fact, every enterprise wants to
work with qualified people. However, both employees and employers have mutual
expectations. Taking these expectations into consideration in a legal framework leads
to the necessity of employment contract. The termination of employment contracts
imposes a number of sanctions on both employers and employees. In this context, both
the labor courts and the special arbitrators have pointed out that the reasons for the
termination of the contract have been made for justified and valid reasons. Indeed, if
contracts are not made for valid reasons, courts usually make decisions in favor of the
employees. As a result of the literature review, it has been observed that employers
terminate their employment contracts unilaterally for many different reasons.
Contracts terminated for reasons other than termination reasons caused by the ethical
attitude of the employee cause the victimization of the employees. In addition, it was
determined that many companies did not make employment contracts. When the
employer calls the right to sue the employer, the results are in favor of the employer,
but the same employers are hard to work with. At this point, the employer's audits
should be done by the state and public institutions frequently and meticulously.
